Terms of Service

Welcome to www.esimcan.co, operated by AG DIGITAL SERVICES, a company registered in Canada (“Company,” “we,” “us,” or “our”). By accessing or using this website and purchasing our products, you agree to these Terms of Service (“Terms”). Please read them carefully. 

1. Nature of Services

AG DIGITAL SERVICES acts solely as a reseller of digital connectivity services provided by independent third-party telecommunications carriers and network operators. We are not a telecommunications carrier, mobile network operator, or internet service provider. eSIM products provide access to mobile data services made available by third-party network partners. 

2. Digital Delivery

All eSIM products are delivered electronically via QR code or activation link. Delivery is considered complete once the QR code or activation details are made available to the customer via email or account dashboard. No physical SIM cards are shipped. 

3. Service Availability & Network Conditions

Service coverage, speed, and availability depend entirely on local carrier infrastructure and device compatibility. We do not guarantee uninterrupted, continuous, error-free, or always-available service. Service interruptions, throttling, or temporary unavailability due to carrier limitations, network congestion, or maintenance do not constitute a breach of contract

4. Device Compatibility

Customers are responsible for ensuring that their device is carrier-unlocked, supports eSIM functionality, and is compatible with destination network bands. We are not responsible for service issues caused by unsupported or incompatible devices. 

5. Refund Policy

eSIM products are digital goods.  Refunds are available only if:

The eSIM has not been installed or activated; and 

  • The request is made within 25 days of purchase. Once an eSIM is installed, activated, or data usage has begun, it is considered delivered and used. In cases of verified technical failure attributable to activation errors, our sole remedy shall be, at our discretion, replacement of the eSIM or a refund of the unused portion.

6. Third-Party Services & Systems

Our website may integrate third-party systems (e.g., for payments, loyalty programs, or referral tracking). While we select partners carefully, we are not responsible for their performance, service interruptions, or privacy policies. 

7. Limitation of Liability (CRITICAL)

To the maximum extent permitted by applicable law, AG DIGITAL SERVICES shall not be liable for:

  • Indirect or Consequential Damages: Including but not limited to loss of business, revenue, profits, data, travel disruptions, missed flights, or accommodation losses, even if we have been advised of the possibility of such damages.

    Extreme Risks: In no event shall the Company be liable for any loss of life, personal injury, or damages arising from the inability to access emergency services or use our eSIM services.

    Liability Cap: Our total aggregate liability shall not exceed the amount paid by the customer for the specific eSIM product in dispute.

8. Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis. We make no warranties regarding network coverage, signal strength, data speeds, or continuous availability. 

9. Dispute Resolution & Governing Law

Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be resolved by binding arbitration in Ontario, Canada, governed by the laws of Ontario and the federal laws of Canada applicable therein. 

Notwithstanding the above, consumers in the European Union retain the right to seek remedies under the applicable laws of their member state and EU consumer protection regulations. Nothing in these Terms limits any statutory rights that cannot be waived under applicable law.

10. Policy Updates

We may revise these Terms at any time. For material changes, we will notify customers via email or a prominent notice on our website prior to the change taking effect. Continued use of our services after notification constitutes acceptance of the updated Terms. EU consumers will always be informed of material changes in advance.
